Untappd, Inc. (“Untappd”) provides the Untappd Shop (the “Shop”) as an electronic platform for the purpose of connecting consumers over the age of 21 (“you”) to Quench It, Inc. d/b/a Half Time Beverage (“Half Time”), who engages in the sale, fulfillment, transportation and shipping services for alcoholic beverages (“Products”) through the Shop. The following general terms apply to all transactions conducted through the Shop.

You access and use of the Shop is subject to Untappd’s Terms of Use located at https://untappd.com/terms and Untappd’s Privacy Policy located at https://untappd.com/privacy, as each may be modified by Untappd in its sole and exclusive discretion from time to time. Through your continued use of the Shop following any such modification, you confirm your acceptance of the revised Terms of Use and/or Privacy Policy, including all the terms incorporated therein by reference.

Half Time’s Terms & Conditions located at https://halftimebeverage.com/terms-conditions apply to your transaction. Half Time may specify additional terms for any such transaction, and Half Time’s additional terms shall control with respect to all transactions with such Half Time.

All alcoholic beverage sales, fulfillment, transportation, shipping, and support services conducted through the Shop are solely transacted between you and Half Time (and not Untappd) from the location of the applicable Product inventory to the shipping destination that you specify in your order. Untappd is not a party to any such order, and Untappd is not responsible or liable for and does not guarantee any obligation of Half Time to you. Without limiting the foregoing, Untappd is not responsible or liable for any failure of Half Time to complete any transaction, fulfill an order, and/or pay for Products. For the avoidance of doubt, neither Untappd nor any of its parents, affiliates, and/or subsidiaries does not make available, produce, provide, sell and/or resell alcoholic beverages or alcoholic beverage fulfillment, transportation, or shipping services, and is not a licensed alcoholic beverage transportation carrier or retailer. Untappd makes no representation as to any laws, rules, or regulations of any jurisdiction regarding the production, sale, fulfillment, transportation, and/or shipping of alcoholic beverages to any consumer, including you. YOU HEREBY ACKNOWLEDGE AND AGREE THAT UNTAPPD IS NOT ENGAGED IN OR RESPONSIBLE FOR THE PRODUCTION, SALE, FULFILLMENT, TRANSPORTATION, AND/OR SHIPPING OF ALCOHOLIC BEVERAGES. ANY DISPUTES BETWEEN HALF TIME AND YOU RELATING DIRECTLY OR INDIRECTLY TO ANY PURCHASE OR SALE OF PRODUCTS, OR ANY ATTEMPTED PURCHASE OR SALE OF PRODUCTS, MUST BE RESOLVED ENTIRELY BETWEEN HALF TIME AND YOU, AND YOU HEREBY FULLY RELEASES UNTAPPD FOR, FROM AND AGAINST ANY AND ALL PRESENT AND/OR FUTURE CLAIMS REGARDING ANY SUCH DISPUTES.

Untappd makes no representation to the legal rights of anyone to ship or import beverages containing alcohol. It is the responsibility of Half Time and any shipping provider(s) that it uses to verify your location, identification, and age, and to determine whether it is legal and otherwise safe and appropriate to sell and furnish you with alcoholic beverage Products. You authorize Half Time to act on your behalf to coordinate fulfillment of your order to you.

You understand that the regulations and court decisions affecting the interstate sale and shipment of alcoholic beverages are in constant flux and can change at any time. Therefore, Half Time may change the jurisdictions to which it is able to permit product transactions at any time and without notice to you. You are solely responsible for the sale, shipment and importation of product into the jurisdiction of your shipping destination. Half Time cannot ship Products to zip codes that have enacted local option to exclude the sale or shipment of alcoholic beverages. By purchasing Products, you verify that you have checked your local laws and have confirmed that importation of alcoholic beverages is permitted.

As Products contain alcohol, Half Time is required to ship with Adult Signature Required, which means you will be required to show your ID to the delivery driver prior to taking delivery. In addition to the Adult Signature requirement, Half Time is required to ship all alcohol Products in approved shipping containers to ensure they are handled properly. The title to Products is passed from the seller of the Products to you as the buyer at the time of the sale and you as the buyer remain responsible for shipping and handling costs, including insurance. All shipping package costs will be added to your total at checkout.

Adult Signature Required shipments may require an additional surcharge which will be passed on to you. In the interest of avoiding missing deliveries, you may consider using your place of work as the delivery location. You may also opt to pick up your package at a shipping facility near you.. If your package is returned to Half Time by the shipping company, Half Time may re-ship it to you for additional shipping charges, but under no circumstances will you be entitled to any refund. If any recipient is found to be under the age of 21 by the shipping company, your order will be returned and no refund will be given.
